Despite a number of positive results in the War on Terror, the insane "poor prisoner" mentality of the "new American" justice system is trying to screw us again.
Libertarian's Still Knifing the War on Terror
An anti-government radical judge Shara Scheindlin 1 has released a terrorist Osama Awadallah saying she believes the man is not guilty of perjury because a Grand Jury is not a criminal proceeding and that Awadallah lying to the Grand Jury did not constitute perjury.
Then there's the shoe bomber's lawyer Owen Walker 3 saying it's all a misunderstanding and his confession was taken after he was drugged and was "incompetent". This despite his shoes being moulded of enough Plastique to blow a hole in the side of the plane he was flying in from Paris to Miami and that he was trying to light a fuse intended to detonate the shoe bombs. Witnesses on the flight say the guy went off his nut when half the plane, literally got up to help restrain the would be murderer. Reid is lucky he wasn't torn to shreds by the angry passengers.
It gets worse. There's Jose Padilla's lawyer Donna R. Newman 2, whining that he is being held illegally cuz he hasn't yet been charged and that he can't be held as a "enemy combatant", which incidentally the Bush administration claims allows the government to hold him incommunicado indefinitely while he is being interrogated. Obviously, Padilla, suspected of making plans to pick a target for a "dirty bomb" is also a poor, misunderstood radical Islamic boy scout.
Then you have the nutsy' judge, William Young, who threw out one of the charges against Richard Reid (the shoe bomber) because he interpreted the USA Patriot Act of 2001's wording of a vehicle of mass transportation NOT to include an airliner (which the law was directly targeted at....sheesh!). According to the AP story,
"U.S. District Judge William Young said that although an airplane was engaged in mass transportation it is not a vehicle as defined by the new law [Patriot's Act of 2001]." 3As one of our friends in the Midwest remarked, "Where do they find these people?" Our answer is from the same Universities that brought us anti-government radicals preaching to students how the U.S. deserved 9/11 and gave tenure to a known terrorist who is now running around in the Middle East trying to avoid being captured. You see, the problem is not lawyers, but radical Libertarian lawyers and judges who don't realize that they are on the bench to make judgements, not excuses for criminals. And the schools that have taught these "patriots" that a bleeding heart is far more important than common sense or keeping your family safe from the evil stalking them TODAY!
The spirit of the law is usually written into new laws in modern times because there is always some stupid lawyer who tries to rewrite history and the intent of the framers of law. So the (hopefully more reasonable) lawyers in Congress now write down their intent in the language comprising the forward of the law. "It is the sense of Congress..." wording sets out the why so it removes the interpretation by whiners looking for a loophole. Looking at the Patriot Act forward, you can easily see the intent is to include all vehicles such as buses, ships, trains and aircraft used to transport passengers. You only have to read it, something this dim bulb Judge William Young obviously couldn't or simply refused to do -- wouldn't want to be blinded by the facts. Young should be brought up on charges and we certainly hope the Justice Department will appeal the ruling.
Fortunately, the judge couldn't help Reid wriggle on the remaining eight
charges, it is rather hard to say Plastique is normal tread material for your
sandals, even if you frequent the Middle East a lot. And of course
everyone lights their shoes now-a-days. It's simply normal
behavior. Fortunately, somehow, blowing up an airplane is still a
felony. Wow, "No Duh" as they say in L.A.
Now You Know Why Bush Wants Tribunals
Is it any wonder then that the administration quickly fired up the old Military Tribunal laws and has started reaching back to the bad old days to when you could hold your enemy prisoners indefinitely and question them with all that the Geneva Convention allows?
And the Libertarians and their radical left lawyers are jumping up and down screaming. Good. Maybe they'll have coronaries. At this point no one expects them to be happy. After all, they are too busy drafting the revisions to history around 9/11 to comprehend that we are fighting for our survival. Oh yeah, we should be concerned that Padilla could be you or I -- that the government simply says you or I have been meeting with Al Qaida and we vanish into interrogation on some military base. Sounds like the X Files. Only, guess what. Judges get to look at that too. Convincing a judge to drop habeas corpus for U.S. citizens is no easy task, regardless of what the Patriot Act says... "Charge em or cut em loose". Regardless of the provisions of the enemy combatant in the Geneva convention -- which says of combatants out of uniform -- you can do anything you want including shooting them on the spot.
Then there's the idiots that say, "We aren't at war, Congress has not declared war, and there is no nation to declare war against!". Right and Osama Bin Laden is a simply a nice Saudi national intending to bring peace and love to Americans all around the world.
Go back and look at the Constitution -- war is well defined and guess who gets to declare it...not Congress. Even the War Powers Act re-iterates all this. If the President says he is fighting a war, and Congress so much as nods their head (which they did in writing, thank you very much), then folks we are war.
If in doubt, look at the State of the Union Address. The President, before a joint session of Congress declared War. And while there wasn't a vote after the President's speech there was NO dissenters visible and anyone with an ounce of brains would take standing ovation after standing ovation as plenty of "ayes" from both Houses of Congress. The nit pickers will say, "Hey that wasn't a vote!" A good old western sheriff would fill those nit pickers with lead.
So once again we are reduced to wonder and utter a remark that is by now almost traditional. "Hey Libertarians and radical leftists, get a frickin' clue!". On the other hand, the idiots are killing their own cause, as more Americans shake their head say, "they just don't get it." So, perhaps we should be happy. Nothing would please us more than to see these fools driven into the corner with a dunce cap. "Sit down and shut up!"
Our friend Bill O'Reilly, is going ape shit, calling for Judge Scheindlin's impeachment by Congress. We support you Bill!! But, something about Wyatt Earp pluggin' 'em does have a certain appeal.
