Immigration Bill Hoax, May 21, 2007

Time for anger management classes, I expect.  In looking over the immigration bill being debated in Congress, my temper went through the roof.  Of all the useless bills ever proposed...the emotional rant could continue for hours, probably will.  Suffice to say that the bill is the largest hoax foisted upon the American people in the history of Congress.  In 2008, we should vote out every member of Congress who voted for or proposed this bill.  It is high time that Congressional B.S. should earn the pay it deserves...they should become jobless.

In trying to curb the emotion, I sat down and wrote out the top ten problems created by illegal immigration.  Then I looked at what kinds of fixes would best serve the American people.  Then finally, I looked at the new immigration bill and was disgusted.  Of the top ten items, only three items were even addressed by the legislation, but then these didn't even come close to providing a solution...the bill provided non-solutions not even worthy of debate.  The chief complaints for the proposed legislaton is that it ignores the illegal count in legal programs, thus making a sham of precautions taken in those programs since illegals have destroyed any possible of the infrastructure to support legal aliens and guest workers, and the complete disregard for mandatory sentencing for those who defy current or new immigration laws such as sancutaries both in terms of organizations and cities or states defying U.S. federal immigration laws.

The only thing that I see this bill doing, and this assumes one particular provision actually works (which is quite debatable) is that if illegals already in this country pay a fine and promise to leave, this will provide income to the government which in turn COULD be used to offset costs of illegals in this country.  This assumes too that such cash would actually make its way to those elements in our society that occur the costs...local emergency rooms, police forces, schools, etc.  There are no provisions in the bill spelling in any useable detail out how this cash will be spent, instead the provisions simply create a state relief fund with no legal requirements for the distribution or use of those funds.

In my opinion, the bill is nothing more than an election gambit with no serious chance of changing any element of the immigration control problem in this country.

Illegal Immigrants Use Up Health Resources (emergency rooms and their staff) for Low Income Americans
Refuse non-life threatening healthcare to illegals, report illegals applying, huge penalties for not reporting. Those under life threatening care will be placed under watch and arrested upon recovery and deported.

Illegal Immigrants give birth to new children who become citizens
No citizenship for children born in U.S. of illegal immigrants, no adoption allowed for children of illegal immigrants.  Parents and children seized at hospital and deported.  Helping birthing of illegals at home to be prosecuted with huge fine based on income and huge jail sentences.  Illegal immigrant parents who choose to give birth at home and whose children die as a consequence will be tried for murder under special circumstances and receive the death penalty.  (in other words, if you are an illegal and give birth you should do so in a hospital and be expected to be deported).

Huge penalty and disqualification for office for accepting services or cash from illegal immigrants.

Not Even Close = Bill purports to address the problem but the solution offered is ludicrously ineffective and a waste of time and money.

Like any legislation, the bill being debated does have several interesting twists that might be useful, perhaps if stripped out and provided in a much more focused piece of legislation. Here are a few of our favorites:
  1. Provision to purchase and operate overhead surveillance drones along the border.
  2. Use of biometric data on illegals captured and/or allowed across the border on visas.
Things to watch out for in this legislation:
  1. Border control provisions are a joke.  Nothing in this legislation will secure the border other than perhaps the addition of surveillance drones and a few more officers.  The effort is far too little and far too late.  Indeed border fencing seems to be the big deal, yet does not place armed forces of any dimension capable of protecting those climbing or tunneling such fences, or more likely simply avoiding fenced areas.  Armed incusions from smugglers (human or drug trafficking) do not seem to be addressed by the legislation yet border county law enforcement remained overwhelmed and not engaged due to the danger.
  2. Few if any mandatory penalties in the legislation makes it toothless. For instance, reams of regulations on employer requirements to curb hiring of illegal aliens create reams of paperwork for employers, yet if they don't comply, there are no jail time sentencing requirements.  Thus a judge in California could easily give a favorite employer 1 weeks public service for failing to comply with the new regulations or simply fine the employer with no other sentencing.  Fines are high per illegal alien found to be illegally hired, however it may be difficult to assess the fine as the legal language is complex and difficult to parse.  Look for lots of courtime...serving again to make lawyers big bucks while employers accused of hiring illegal aliens pay for the pleasure to their consul.  In the end, aside from draconian fines, the worst that can happen to an employer is that they cannot apply for federal contracts or use the alien hiring system EEVS.  Oh dear.
  3. Required judicial review of every element of the legislation will create a vast new legal industry, wherein illegal aliens and employers can tie up immigration issues, deportation, and even confinement for months.  Illegal aliens are being granted a full set of citizens rights in most provisions of this legislation.
  4. Provisions clearly allow a judge to grant them an "alternative" to incarceration such as electronic monitoring devices.  This does not prevent captured illegal aliens from being released back into the population and then removing the electronic device and then fleeing.  There are also no funds for monitoring or rapid response to electronic monitoring device activities, making this portion of the legislation useless if not a joke.
  5. The "Y" temporary worker visa described in this proposal assumes the worker will come into the U.S., perform the labor specified under the visa and then voluntarily leave.  This is a joke.  All a Y visa worker need do is get in the U.S. and then take off.  There are no provisions for monitoring individuals and certainly little to do with monitoring Y visa runaways.  This creates a huge hole for legal entreants (similar to all the other previous programs) to become illegal aliens at large in the U.S.  It assumes the best of human character that only exists in a few individuals, clearly naive and irresponsible.  Also the legislation, rather than prohibit chain immigration, has provisions for the worker to bring child and caregiver for that child into this country as well.  Thus for each Y visa worker, you add at least two additional immigrants who can run from the system as soon as they are in the U.S. or who while in this country legally, continue to provide hardship to the healthcare, education, and legal system.  Again, there is no mention of the number of illegals in this country, therefore this provision ignores the impacts of illegals and promulgates legals into a system already overtaxed by illegals as if illegals do not exist.
  6. Voluntary return:  The provisions of this legislation require that a bond be paid by those voluntarily leaving, except for cases of hardship.  Well, hell, it is clear that bleeding heart judges will be waiving that bond in wholesale numbers.  The bond is intended to be held until an illegal leaves the country and proves they have left before it is refunded.  It is our belief that few bonds will ever be collected even if not waived by judges.
  7. Immigration visitors:  The proposal continues provisions for family visits...a temporary worker or student in all classes may receive alien visitors for up to thirty days.  This allows aliens into the country to visit and once again, also provides for them to flee the system.  With family here, the alien may become an illegal alien by simply quitting work and moving on, taking his or her family with them to their new digs in another city or state.
